The U.S. rescinds an administrative review of the countervailing duty on Vietnam's steel nails

The U.S. Department of Commerce (DOC) has announced to rescind the administrative review of the countervailing duty (CVD) order on certain steel nails (steel nails) from Vietnam for the period January 01, 2016, to December 31, 2016, according to Vietnam Competition Authority.

Pursuant to the U.S. Code of Federal Regulations, if the petitioner withdrew its request for review by the deadline (within 90 days of the date of publication of the notice on initiation of the requested review) and no other party requested an administrative review, the DOC will rescind an administrative review, in whole or in part.

In this case, on July 03, 2017, the DOC published in the Federal Register a notice of opportunity to request an administrative review of the CVD order on steel nails from Vietnam for the period January 1, 2016, to December 31, 2016.

On July 31, 2017, the DOC received a timely request from Mid Continent Steel & Wire Inc. (the petitioner) to conduct an administrative review of this CVD order with respect to 14 Vietnamese companies. Based upon this request, on September 13, 2017, the DOC published in the Federal Register a notice of initiation of administrative review for this CVD order.

On September 28, 2017, the petitioner timely withdrew its request for an administrative review for each of the 14 companies.

Accordingly, the DOC will instruct U.S. Customs and Border Protection (CBP) to assess CVDs on all appropriate entries at a rate equal to the cash deposit of estimated CVDs required at the time of entry, or withdrawal from warehouse, for consumption, during the period January 1, 2016, to December 31, 2016.
