Tax collection under strict scrutiny at casino operating enterprises

Facilities and equipment are required in casino to serve the management of tax authorities.

The Ministry of Finance (MoF) has issued Circular No. 146/2017/TT-BTC guiding the management and supervision of tax collection for casino business. This Circular will come into effect on February 12, 2018.

Accordingly, casino-operating enterprises must compile and issue regulations on internal management in their casinos as stipulated in Clause 1, Article 18 of Decree No. 03/2017/ND-CP dated 16 January 2017 of the Government on casino business.

Clause 1 specifies management of money, conventional currency and management organization to ensure the separation among the vault, the cashier and the prize-winning gaming tables and gaming machines.

Casino-operating enterprises are only allowed to exchange conventional currency for gamblers before they gamble at the cashier, or gaming tables and return money to gamblers at the cashier. The management of foreign exchange for casino business shall comply with the guidance of the State Bank.

All transactions involving money and conventional currency must be monitored through computer software, and the data must be transferred to the revenue summary slip in accordance with the specified form. At the same time, these transactions must be recorded and reported to the relevant State agencies.

Casino-operating enterprises must arrange specialized gamble boxes to contain cash and conventional currency. These boxes must be sealed before being taken out of the vault and immediately after being removed from the prize-winning game tables and machines.

Regarding the tax management of casino operating enterprises, enterprises must arrange the necessary facilities and equipment in casinos as prescribed in Clause 1, Article 40 of Decree No. 03/2017/ ND-CP so that tax authorities can manage and supervise directly or through electronic devices and camera system.

The installation of electronic devices and camera system in a casino and the storage of images via electronic devices and camera system must comply with Decree No. 03/2017/ND- CP. Since then, the tax authorities can access the electronic devices and camera system to serve the management of revenue and tax.

Casino-operating enterprises shall declare and pay taxes in accordance with the Law on Tax management, Law on Value Added Tax, the Law on Excise Tax, the Law on Enterprise Income Tax and the documents guiding the implementation thereof.
